| Even after a handful of laws which have been accepted for protection of children in requirement of care and protection and teenagers for the conflict to the law....., cares, and protection has not reached the tender aged in real sense...!!!!! |

As children’s day comes nearer, the thought has struck mine mind … yes very much the basic aspect of protection of children our society. Every year on 14th of November, among our occupied and hollow way of life with all our echo and highly does giving, we speak about maintenance of protection, safety and justice to children of our society. But the truth behind our negotiations leaves, when on very next day we rise in the morning and we open a door for the maiden who is approximately 12 years, the little boy at the age of approximately 11 years, placing the newspaper in our place every morning or when we are on road, and the young guy comes and asks about food - the UNIQUE THING by which we DO "IGNORE".
We speak about maintenance of children of our country with each benefit, all sources of development, social values, the economic help, illness free environment and in simple words - the GOOD LIFE. But if is carefully analyzed we will understand, that everything, that we have made and we do, only to be made and are not actually made. That we name the efforts, only other way to show our anxiety for a society and anything other. To today when already the handful of laws has been accepted for benefit and well-being of children in India, clear discrepancy between the established laws and the made performance can be noticed.
When we think of a word "child" as a society part, the government takes away itself from its duties; we as the person hardly show any interest or anxiety for the most important strat our lives and the future Hindus, laws lack the severity demanded appropriate functioning of the authorities.
We notice the child only when it becomes the social far-outer or has entered into the law conflict. The authorities established for well-being of children according to various laws, is included into function only when the child turns to the far-outer instead of functioning in very beginning, helping those who, possibly, will give a miss to their parents or it is good wishers to join not standard brotherhood.
Young justice - one of the several measures accepted by the state to reach vision and the purpose of the Constitution of India, concerning care and well-being of children. The constitution recognises the special status of children through articles 15 (3), 24, 39 (e) and (f), and 45. According to the constitutional instructions, various laws which cover a wide range of the questions, concerning children, for example, acceptances, service, guardianship have been ordered, to legality, work, formation, offence, etc.
According to these conditions, the legislature has transferred Young Justice (Care and Protection) the law, 2000 with representation not only protection of teenagers in the conflict to the law but also and those who is in requirement of care and protection. The law speaks about acceptance of the friendly approach for development and well-being of children in our country so that children could avoid long procedures of court and could be rehabilitated instead of were fined for injustice.
It is necessary to understand still, that protection and justice for children not only wish to protect those children who have transferred a crime but also and those who, possibly, will step in the crime world. Kept away all of us yet in a condition to protect those children who have already transferred a crime from thought on release or have been pursued. The analysis of operations according to various Laws on children and Young laws of Justice shows a wide interval between the theory both practical performance and the statement of the young law in India.
Conditions of the existing law hardly are carried out by, whether it should be the reason to be shortage of resources, below standard services and any realisation behind laws. Children in young houses live from time to time in the majority of severe conditions where protection - the remote agenda – and the basic requirement of pure environment for simple residing also is denied. The teenager and protection houses in general are overflowed not, leaving areas of restoration for even the only child. As there are no minimum standards for the main requirements and life conditions, children are easily compelled to live a life in the worst possible conditions.
There is noted distinction in the politician and realisation. Litigations are noted by intensity between the protective approach of the Young law of Justice and the traditional approach to contact to a crime. While higher courts in most cases advance philosophy of care-and-protection of Young System of justice, there is very small understanding in lower judicial power about procedural distinctions between tests of accused adults and children.
At the government and other authorities are not present any political pressure upon them and besides as there is no the political interest involved in children’s well-being and improvement, there not the regular checks supported on functioning of young system of justice in India. Its only thing when the social problem concerning protection of children is lifted because of some coming national or international informal meeting, that the authorities function also we understand, that something in this aspect should be made, but as the problem falls down, even we release stimulus of advancement of it.
Regardless of the fact that can cause behind default and improper functioning, this problem still has not met, it comes to an end also children in our country, whether transfer expressly or by implication the same conditions and circumstances and in the restoration centres, prisons and also when them leave outside ignored by each of us. Children who are bad, more possibly, will step in not standard character because of shortage of food, formation, low economic status etc. Knowing the status of young system of justice in the country as ours it becomes valid our responsibility as a part of our society to protect and assist the future of our country …. |
